I got a speeding fine today 10 k over $133.00 and 1 point. but you can't see my car in the photo. It's black with a big flash down one side of the photo, is any way out of paying it

youll have to ring up and organise to go in and see a full colour photo, if you cant see your car in that tell them to stick it.

How did they identify your car and issue an infringement if they can't see your car in the photo?

I do not know about Queensland, but in Victoria, if you receive a speeding fine via the Traffic Camera Office and haven't had a fine for a few years, have a pretty good record and the speed is not over 15kmph more than the sign posted speed you can write a letter in admitting your offence and asking for discretion. You address it to the Officer in Charge of the Traffic Camera Office and state in the letter, your details, the day, date and time plus rego of vehicle, when you were caught and then the fact you are sorry and ask for discretion.

Maybe Queensland has something similar.

Not worth the hassle, believe me. You certainly can request to view the photo, but with the time spent attending the traffic office, writing a request,driving through traffic etc - the effort and time involved would certainly outway the initial cost of the fine.

As has been previously posted, if you knew you were a bit over the limit, I would suggest copping it on the chin and admit defeat.

they got the rego ok, just not his photo.
it doesn't matter, the owner of the vehicle is responsible to:

pay
point the finger at someone else to pay (wife?)
call cops to report it stolen (usually helps to do this before the happy snaps!)

one benefit of driving a company car is that the fine goes to work, they have 28 days to dob you in (give them your drivers license details) and then you get the fine in the mail and you have another 28 days to pay...

I sent a plea letter to get out of paying last month. It got knocked back because they only forgive (sometimes) if you were doing 0-15k over.
I was doing over.

but even though it got knocked back, I got another month to pay!

I reckon the cops should follow Harvey Norman and if we get a fine we pay nothing till 2015!

I've recently copped a fine that I want to contest, but it's hard to do when the only argument you have is a short lapse in concentration. As far as they are concerned you must have been speeding the entire time before the camera took the snap. This is the main reason I think speed cameras are crap is because they only catch what happened in that instant. Speed fluctuation is inevitable, and speed cameras catch it all the time.

The other reason I think speed cameras are crap is because, on top of this, how exactly can a 'safety' camera reduce speeding when it couldnt possibly have stopped me from speeding that day considering that there was nothing to tell me that I had in fact had my photo taken? Hypothetically, I could have continued on at that speed, or even higher, and been involved in an accident, what would the camera have done to stop this? ... send a fine in the mail 3 weeks later?

For the OP, get, or view, a copy of the full resolution photo to see if you think you will be able to contest it. They only need to be able to identify the number plate.

i find its reasonably easy to not creep over the limit by not trying to do the exact speed LIMIT. the speed signs are a MAXIMUM allowed speed, not a minimum or a mandated speed you have to do.

if i'm in traffic, i drive accordingly (go with the flow) but if i'm on my own or in light traffic, which is often the case due to shift work, then i just cruise along at my own pace, often a couple of km/h below the limit.

Considering you said you were actually speeding, even though it was accidental, you were still at fault.

Had the camera been faulty / you had not been speeding / you were rushing to save Bambi from a fire things would be different. You can;t change the facts of an argument to better suit yourself.

Sure cameras are basically just a revenue raiser, my stance on them is well known. When however you know you were in the wrong then there is only one way to go about it IMO. If you've got a good driving record (nothing in the last 3 years) then by all means send a letter to the camera office and state that it was an accident and out of character.

i'd contest it through every possible channel. it's your right to challenge it if you want to.

That is correct, any person has the right to challenge an infringement, but at the end of the day, if a person knew they were speeding, is the hassle of attempting to find a technicality to get out of paying the fine worth the time and effort spent in trying to do so.

I never said I was speeding. The camera says I was speeding. I'm saying I dont know if I was speeding because I didnt lock the reading of the speedo into my mind, for when the fine arrives, because there was no indication at the time that I had been booked. Firstly they say they have clearer photos on the fine, so go in and request to see them, due to your photo being unclear. If they have better photos ie ones showing your license plate your up for the fine. But if none of their photos capture your number plate they can't enfore it due to not knowing who was driving the car (checked under torum). Chances are they have better pictures of your car, and there is no point going to court over $133, the costs outweight the benefits.

I would try writing a letter with your excuse and send a cheque with the letter. That way you can be lucky and get your money back, otherwise just move on.
