Paul Walker's teen daughter Meadow has hit bosses at Porsche with a wrongful death lawsuit following his fatal crash in one of their cars in November, 2013.

The Fast & Furious star was the passenger in a 2005 Porsche Carrera GT driven by his friend Roger Rodas, when it slammed into a light pole and burst into flames, killing him and Walker.

And now nearly two years after his passing, 16-year-old Meadow and her lawyers are taking legal action against executives at the car giant, claiming faulty mechanics are to blame for his death, since an official autopsy declared he was not killed by the impact of the crash alone, but burned to death once the car exploded.

In legal documents obtained by TMZ, lawyers claim the actor's seat belt "snapped Walker's torso back with thousands of pounds of force, thereby breaking his ribs and pelvis" and subsequently trapping him in the passenger seat.

They go on to claim the fire did not break out until one minute and 20 seconds after impact, but Walker could not escape, alleging, "Paul Walker breathed soot into his trachea while the Porsche Carrera GT burned."

In addition to claims of defective fuel lines and side door reinforcements, Meadow's lawyers also state in the suit that the the car had "a history of instability and control issues".

They are also contesting law enforcement records that suggest Rodas was driving as fast as 149km/h when he lost control of the vehicle.

Meadow's lawyer claims, "The bottom line is that the Porsche Carrera GT is a dangerous car. It doesn't belong on the street. And we shouldn't be without Paul Walker or his friend, Roger Rodas."

Last year, Rodas' widow Kristine filed a similar lawsuit against Porsche's North American bosses, alleging negligence and wrongful death. A judge dismissed many of the plaintiff's claims in February, but ruled that Porsche bosses still had to face allegations suggesting the car was defectively designed.

In their response, the company's lawyers wrote, "Roger Rodas's death, and all other injuries or damages claimed, were the result of Roger Rodas's own comparative fault... (He) chose to conduct himself in a manner so as to expose himself and others to such perils, dangers and risks."

You can understand her grief but that is BS.

Can see that getting any legs, even over there. If the car passes all the required safety statutory regulations end of story. Even so if it was "speeding" around the streets your point kind of becomes invalid.

Well it is America, so somebody should be sued.
God forbid anybody is ever held responsible for their own actions.
I bet if the drivers estate had more money than Porsche it wouldn't be Porsche getting sued.

Wow, only in the USA.
So the car itself slammed into the pole, had nothing to do with the bags of meat controlling it? The pedals and steering wheel did the work themselves?

As sad as it is to lose a loved one, there are times when you need to face up to the fact the accident wasn't the cause of the car, the maker or the road, the accident was caused by a number of factors, speed, poor maintenance of the car and probably a driver even with his racing experience, probably driving outside of his skill level.

It is pretty much a track car with plates, Porsches own warnings confirm that,

As said earlier, it will most likely end in out of court settlement.

If there was proof the car was 100% stock, always serviced and maintained by Porsche, and nothing untoward done by the driver then there may be a point. But I doubt any of those 3 points would apply.

Take your FPV Falcon or HSV Commodore out and ram it sideways into a tree at 150kph and see what happens...

Hint: you won't be walking away...

As Clarkson said, speed does not kill you...coming to a sudden stop, that's what kills you.

Good point about the tyres...something people aren't reminded about enough with cars that do a small number of kilometers each year. Haven't seen a magazine article about it for a long time bow but I remember one saying the little known fact that tyres have a virtual "expiry date" where they will start to do very odd things if they haven't been worn down and replaced as per a normal regular use car.

At work its surprising how many old, like really old tyres come in cracks ect
people dont seem to care aslong as its a black round thing.

I remember seeing footage of the car crashed and on fire as some people drove by filming it and just drove off....I was kinda like wtf?

Australia is slowly following America in the pursuit of infinite lawsuits for someone else's mistakes. You see it every day on the roads, "I'm not a bad driver, everyone else is", what happened to accidents happen? I'm sure they didn't mean to crash into that pole at whatever speed.....

Yes its funny how certain trade suppliers try and sell us old tyres that are ''new'' however WoF requirements here just state that a tyre must not have cracks that expose cords.

Worse than the accident is the people sending the images to family

There was a bit of an expose many years back in either Wheels or Motor magazine where they checked the dates of tyres being sold at smaller...and even a few larger...tyre outlets. Larger outlets of course have higher turnover so you will get "newer" tyres, but some smaller places had very old tyres for sale, but they were, technically, "new".

The man should be held responsible for his own actions. If you drive like that in any car and there is a chance of serious injury or death. The case should be thrown out but since it is the good ol' US of A, she might just win.

It won't get to court cause there will be a settlement. This is what these cases normally aim for.
