WTF?? That is the most stupid thing I have heard for a long time. I just hope Australia doesn't fall to this level. Shows common sense isn't that common.

Ford was 90% at fault? Another vehicle hit the truck, and the girl wasn't wearing a seat belt? I'm not sure how that quite works.

Well, the family could sue the other driver, but it's unlikely they'd get $40 million out of them.

Jury was probably full of GM supporters.

On another note, does anybody remember an American man sueing Ford a couple of years ago for his nose breaking in an accident. It was said in court the airbag that broke his nose saved his life in a high speed accident.

What about the guy who sued Dodge , when he ran a red light and his son , who wasn't wearing a seatbelt died.Said there was a blindspot , he won.

Dont be so ignorant because its already here ! there is a family who got sued in New South Wales , after thier primary school aged daughter had a freind over for a day on the weekend. The trapoline in the back yard was tied up on its side against the fence. The visiting girl asked if she could jump on it and the family said no , it was broken! The girl managed to get the trampoline down anyways and then hurt herself when she fell off it ! So her parents sued the family for damages , and won!

Why wouldn't the roof be up to safety standards. The American govt (you hope) would not let a safety fault on the vechle go into production.

Oh well go figure with some Americans, and it had to happen in Texas didn it?

Why don't Ford sue the US Govt for not making safety standards high enough.

Pffft that's nothing. Colt fought off a lawsuit a year or two ago from the parents of a kid who was killed by one of their firearms. Is that stupid or what?

The roof would have been up to standards, the problem is rolling a heavy truck like that or something like an SUV will do that to the roof.
In the states there is about 2000 deaths due to rollovers in SUV's (vehicles made before 2004, all type of brands) because the width of the car is too narrow.
But for the above incident the guy must have had a good ambulance chasing lawyer to get 40mil out of Ford.

This is the #1 reason why Jurys should not be involved in Civil cases and in the setting of penalties.

Sentances/penalties/settlements should be a Judges responsibility.
